Terms of Service

1. Service provider
Wedding and private photography and video services booked on weddingphoto.lu are provided by Andrii Mitin, self-employed (AM SE), trading as "André Mitin Wedding Photo Studio": RCS Luxembourg A44485, business permit (autorisation d'établissement) no. 10153230/2, VAT LU35107862 (small business VAT franchise, VAT not applicable), 3 Rue Jean Schoetter, L-2523 Luxembourg, info@weddingphoto.lu.
The website itself is published by Lux Photo Pro S.à r.l.-S (see the Imprint). Your booking is confirmed by a Wedding Service Agreement that you sign electronically. Where it differs from these terms, the signed agreement applies.
2. Booking and reservation deposit
- Payment is split into milestones, shown at checkout and repeated in your agreement. From 5 hours or €900: 40 / 30 / 30. Smaller bookings: 50 / 50. From 5 hours or €900: a 40% booking deposit reserves your date, 30% is due one week before the shoot and 30% on gallery delivery. For smaller bookings: a 50% booking deposit reserves your date and 50% is due the day before the event.
- Deposits paid via Stripe (card) are subject to that provider's terms.
- Within 14 days of paying the booking deposit (or of signing your agreement, if that is later), you may withdraw and receive a full refund, including the deposit (EU consumer law for distance contracts).
- If your event takes place before the withdrawal period ends, we start the services within that period only at your express request, which you give with a separate tick box at checkout. If you then withdraw after coverage has begun, you pay only a proportionate amount for the services provided up to the moment you told us. Planning, team assignment and other preparation during the withdrawal period are free of charge.
- After that period, the booking deposit is not refunded if you cancel. If we cancel, or cannot perform and there is no replacement and no new date that suits you, you get back everything you paid, including the deposit (section 6).
3. Wedding day services
- Coverage hours and package contents are as configured at booking, captured in your contract.
- Travel is charged only when it appears in your booking. There is no travel fee within 30 km of Luxembourg City. Further away within Luxembourg, a flat travel fee applies; outside Luxembourg, a fee per kilometre one way, counted from Luxembourg City. The rates are shown in the configurator when you book, and the amount is stated in your booking and agreement. Destination weddings further afield are quoted separately.
- If the photographer or videographer assigned to your event cannot attend because of illness, accident or another event beyond our control, we send a replacement from our team of the same or a higher level at no extra cost.
- If you booked the André level and André Mitin cannot attend, we send a Premium-level photographer and refund the price difference, or you may cancel that event and receive a full refund.
4. Delivery
- The delivery time depends on your package and is shown for it when you book: typically 7 to 30 days after the event. There is no separate early preview.
- The delivery time of each deliverable (edited photos, films) is stated in your booking summary and agreement, counted from the date of the event. If we expect to be late, we tell you before the deadline and give you a new date.
- Where a payment is due on delivery, your photos first arrive as a preview gallery with watermarks; the clean download unlocks once that payment is made.
- The final gallery stays online for 12 months from the day it is unlocked. Please download and back up your files promptly.
5. Usage rights
- Once the price is paid in full, you receive a perpetual personal licence to use, print, share and gift the delivered photos and films.
- Commercial use of photos (e.g. promoting a business) requires written permission.
- We keep the copyright. Whether we may publish images in which you appear is your separate, voluntary choice: after the event we ask each of you, in your client account, which channels and for how long. Until you answer, and if you say no, we do not publish. You can withdraw your permission at any time.
6. Moving the date and cancellation
You can ask us in writing to move the date of an event. A move is possible only if a team of the same level is available on the new date; if not, you may keep your original date or cancel. The fee depends on how long before the current date of the event we receive your request:
- more than 60 days: the first move of each event is free, each later move costs €50;
- 60 days or less, but at least 30 days: €50;
- less than 30 days, but at least 7 days: €150;
- less than 7 days, but at least 72 hours: €250;
- less than 72 hours: the date can no longer be moved, and the request counts as a cancellation.
The fee is charged when we confirm the new date. All payments already made move to the new date.
- Cancellation by you after the 14-day withdrawal period: the booking deposit is not refunded. If you cancel 60 days or less before the event, you also owe 50% of the remaining price (the price minus the booking deposit). We refund anything you paid above that.
- Cancellation by us, or a failure on our side (including force majeure on our side) with no replacement and no new date that suits you: we refund everything you paid for the services not performed, including the booking deposit.
7. Limitation of liability
Our liability is limited to the amount you paid. In case of full equipment failure preventing coverage of part of the day, we refund a pro-rated amount based on hours missed.
8. Force majeure
If force majeure (such as illness, accident, severe weather, transport failure, a public emergency or restrictions imposed by the authorities) prevents your event from taking place, neither party is liable for the resulting non-performance, and we make our best efforts to move the services to a new date. If force majeure on our side prevents us from performing and no replacement is possible, section 6 applies: another date, or a full refund including the booking deposit.
9. Governing law
These terms are governed by Luxembourg law. Disputes are subject to the jurisdiction of Luxembourg courts, without affecting the protection that mandatory consumer law gives you.
